By accessing and using ServeSense ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ServeSense provides:

• Restaurant feedback collection via QR codes and web forms
• Real-time analytics dashboard for restaurant owners
• Customer insights and performance tracking
• Menu management and question customization tools

3. Account Registration

To use ServeSense, you must:

• Provide accurate and complete registration information
• Maintain the security of your password
• Be at least 18 years old
• Be authorized to represent the restaurant you're registering
• Accept responsibility for all activities under your account

4. Free Trial and Pricing

You may cancel at any time. No refunds for partial months.

5. Acceptable Use

You agree NOT to:

• Use the Service for any illegal purpose
• Submit false, misleading, or fraudulent feedback
• Attempt to access other restaurants' data
• Reverse engineer or copy the Service
• Use automated tools to spam or scrape the Service
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations

6. Data Ownership and Privacy

Your Data:

• You own all feedback data collected for your restaurant
• We process customer feedback on your behalf
• You are responsible for complying with privacy laws when collecting customer data

7. Service Availability

We strive to provide reliable service but do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages. We are not liable for any damages resulting from service interruptions.

8. Termination

We may suspend or terminate your account if you:

• Violate these Terms of Service
• Engage in fraudulent activity
• Fail to pay subscription fees
• Use the Service in a way that harms us or other users

You may delete your account at any time from your dashboard settings. Upon deletion, all your data will be permanently removed within 30 days.

9. Intellectual Property

ServeSense and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our permission.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• ServeSense is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid us in the past 12 months
• We are not responsible for lost profits, revenue, data, or business opportunities

11. Indemnification

You agree to indemnify and hold harmless ServeSense from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by the laws of Australia. Any disputes shall be resolved in the courts of Western Australia.
